Supreme Court on Power of the Consumer Forum to grant ad interim stay:
Finally on the question of 'ad interim stay' Supreme Court held as follow:
"A CAREFUL READING OF THE ABOVE (SECTION 14 (1) OF COPRA) DISCLOSES THAT THERE IS NO POWER UNDER THE ACT TO GRANT ANY AD-INTERIM RELIEF OR EVEN AN INTERIM RELIEF. ONLY A FINAL RELIEF COULD BE GRANTED."
It is relevant to note that 2002 amendment of the Act has amended the Act, interalia enabling Consumer Forum to pass interim relief: S. 13 (3B). Further S.25 of the Act has been amended enabling the Consumer forum to execute the interim order passed by it. Further the said section provides for enforcement of the order through District Collector just as in the case of arrears of land revenue.
